Facts
The High Court of East Central State gave a judgment based on a statement of claim filed in the “High Court of Biafra” during the civil war.
This was an appeal from that judgment as it was claimed that the Biafran Court was an illegal organ and its judg¬ment must therefore be void and of no effect.
Counsel on both sides argued on the matter with Chief Williams contending that the doctrine of necessity and implied mandate was applicable to the matter and Mr. Offodile contended that failure to file another statement of claim after the civil war was a mere irregularity which had been waived impliedly.
